EFSA Vitamin D Health Claims: The Submission Roadmap
Most vitamin D health claim dossiers fail. EFSA has evaluated over 2,300 health claim applications since the adoption of Regulation (EC) No 1924/2006. Over 260 have received authorization.

The 70% Rejection Threshold
The remainder — more than 70% of submissions — were rejected for insufficient scientific evidence. This rejection rate is not noise. It reflects a deliberate filtering mechanism built into EU nutrition policy: the cause-and-effect standard. A claim must demonstrate that the consumption of a specific food substance produces a defined beneficial physiological effect in humans. Observational data, in vitro work, and mechanistic plausibility alone do not satisfy this standard. The dossier must contain well-designed human intervention studies — typically randomized controlled trials — with the nutrient or substance at dosages consistent with normal dietary intake or plausible exposure scenarios.
For vitamin D specifically, the bar is set by the Dietary Reference Values published in EFSA's 2016 scientific opinion. The NDA Panel established an Adequate Intake of 15 µg per day for healthy adults and children over 1 year, including pregnant and lactating women. For infants aged 7 to 11 months, the AI is 10 µg per day. These values define the physiological range within which any claimed effect must be demonstrated. A study delivering 100 µg of vitamin D as a single bolus and observing a biomarker change does not equate to a sustained dietary contribution. The matrix, the dosage form, the frequency of intake, and the bioavailability yield all enter the evaluation chain.

The regulatory framework governing these submissions has also shifted. Since March 27, 2021, Regulation (EU) 2019/1381 — the Transparency Regulation — has imposed pre-submission obligations that did not exist when most of the current authorized vitamin D claims were approved. Any applicant commissioning or carrying out a scientific study to support a future health claim application must notify EFSA before the study begins. This step precedes dossier preparation. It is not optional. Failure to comply at this stage can compromise the admissibility of the study data at the evaluation stage.
The Regulatory Architecture: Regulation 1924/2006 and Its Operational Layers
Regulation (EC) No 1924/2006 is the foundational instrument. Article 14 governs specific claims, including Article 14(1)(b), which covers claims referring to children's growth and development — a category that captures the core vitamin D claim regarding normal bone growth and development in children. Article 13 covers general function claims, including well-established claims about vitamin D's role in calcium absorption, bone maintenance, and immune function. Each pathway carries distinct evidentiary requirements.
The current authorized vitamin D claims in the EU Register include formulations such as "Vitamin D contributes to the normal absorption/utilisation of calcium and phosphorus," "Vitamin D contributes to normal blood calcium levels," "Vitamin D contributes to the maintenance of normal bones," "Vitamin D contributes to the maintenance of normal muscle function," "Vitamin D contributes to the maintenance of normal teeth," and "Vitamin D is needed for the normal growth and development of bone in children." Each of these claims has been pre-approved by EFSA and is available for use by any food business operator meeting the conditions of use.
The conditions of use are not generic. They specify minimum quantities of vitamin D per 100 g or 100 ml of product, or per portion, that must be present to invoke the claim. These thresholds correspond to the Annex's definition of "source of vitamin D" — the minimum compositional requirement that any food carrying a vitamin D claim must satisfy. A product below this threshold cannot legally bear the claim, regardless of the manufacturer's marketing intent.
Pre-Submission Protocol Under the Transparency Regulation
The Transparency Regulation operationalized a pre-submission phase that applicants historically bypassed. The procedure now runs as follows.
First, the applicant must notify EFSA of the intended study via the ESFC platform — the electronic submission interface used for all regulatory dossiers. The notification must include the study design, the intended start date, the sponsor, and the planned endpoints. EFSA publishes the notification in a public register. This register is accessible to third parties, including competing applicants and civil society organizations. The rationale behind this provision is to prevent retrospective construction of evidence tailored to a desired outcome — a practice that EFSA's NDA Panel considers incompatible with robust scientific evaluation.
Second, the applicant must wait. There is no minimum waiting period mandated by the regulation itself, but the practical requirement is that the notified study protocol cannot be modified post-hoc in ways that would alter its scientific validity. Any deviation from the protocol must be documented and justified in the eventual dossier. Protocol amendments made after seeing interim results — a common practice in industry-funded research — are now a flagged risk factor during EFSA's evaluation.
Third, the dossier itself must be compiled in accordance with EFSA's general scientific guidance, last updated in January 2017. This guidance specifies the structure of the application: administrative data, characterization of the food/constituent, characterization of the claimed effect, relevance of the claimed effect to human health, scientific substantiation (including human studies, animal studies, and mechanistic data where applicable), and proposed conditions of use. Each section requires specific documentation. Incomplete dossiers are rejected at validation — the first checkpoint — before the scientific evaluation begins.
Pre-submission study notification is mandatory for any scientific study commissioned to support a vitamin D health claim dossier submitted after March 27, 2021.
NDA Panel Evaluation Mechanics
Once an application passes validation, the clock starts. EFSA's standard evaluation timeline is 5 months from validation to opinion delivery. This timeline assumes no requests for supplementary information. In practice, requests for supplementary information are the norm, not the exception. Each request pauses the clock. The effective timeline for a contested application can extend to 12–18 months.
The NDA Panel — EFSA's Scientific Panel on Dietetic Products, Nutrition and Allergies — conducts the evaluation. The Panel comprises independent scientific experts appointed through a public selection process. They do not represent member states or commercial interests. Their task is to assess whether the submitted evidence demonstrates a cause-and-effect relationship between the consumption of the food substance and the claimed effect.
For vitamin D, the Panel's evaluation framework rests on the established Dietary Reference Values and the biological role of vitamin D in calcium homeostasis, bone mineralization, and cellular function. Claims that align with these established mechanisms — such as "vitamin D contributes to the maintenance of normal bones" — benefit from a robust biological plausibility. The applicant still must provide human data demonstrating that the specific food product, at the proposed dosage and in the proposed matrix, delivers the claimed effect. This requirement rules out reliance on the general vitamin D literature alone. Each product must be substantiated individually, or, where appropriate, through generic claims that have been pre-approved by EFSA on the basis of the broader scientific literature.
The Panel's opinion is then transmitted to the European Commission and the Member States. EFSA does not authorize claims. EFSA provides scientific opinions. The authorization decision rests with the Commission, acting under the regulatory committee procedure. A favorable EFSA opinion does not guarantee authorization; an unfavorable opinion does block it.
Meeting the "Source of Vitamin D" Threshold
The compositional threshold for using an authorized vitamin D health claim is defined in the Annex to Regulation (EC) No 1924/2006. A food is a "source of vitamin D" if it contains at least a specified quantity of vitamin D per 100 g or 100 ml, as set out in the Annex. Products that do not meet this threshold cannot use the claim, even if the claim itself is authorized at EU level.
This compositional requirement interacts with industrial processing realities. Vitamin D is subject to degradation during extrusion, baking, and high-temperature sterilization. Cholecalciferol (vitamin D3) and ergocalciferol (vitamin D2) exhibit different stability profiles in different matrices. A formulation that meets the threshold at the point of manufacture may fall below the threshold at the end of shelf life. Food business operators must account for degradation rates over the product's intended shelf life and build in overages accordingly. The overage must be justified in the product specification and supported by stability data.
The matrix itself — fat-based versus aqueous, encapsulated versus free — affects both degradation kinetics and bioavailability yield. Oil-based matrices generally provide higher bioavailability for fat-soluble vitamins like vitamin D. Matrix encapsulation technologies, including spray-dried starch matrices and lipid-based encapsulation, can improve both stability and bioavailability. These process choices affect the substantiation dossier: a product that relies on a specific encapsulation technology must demonstrate that the encapsulated form delivers the claimed effect in humans.
Why Vitamin D Dossiers Fail: The Structural Pitfalls
The 70%+ rejection rate is not random. It concentrates around specific failure modes. Identifying these modes before submission is a cost-reduction strategy; each rejected application represents sunk costs in study design, conduct, and dossier preparation.
Insufficient human intervention data. The most common cause of rejection. Applicants submit observational data, cross-sectional analyses, or biomarker studies without a controlled intervention arm. EFSA's guidance is explicit: human intervention studies are required to substantiate a cause-and-effect claim. Observational data can support plausibility but cannot stand alone.
Inadequate characterization of the test substance. Dossiers that fail to specify the form of vitamin D used (cholecalciferol versus ergocalciferol), its origin, its purity, and its matrix fail at the characterization stage. EFSA's Panel cannot evaluate what is not characterized.
Mismatch between dosage and normal dietary intake. Studies using pharmacological doses — multiple times the AI of 15 µg/day — fall outside the framework of a nutrition claim. Such studies may support a medical claim under different regulatory pathways, but not a food health claim under Regulation 1924/2006.
Failure to demonstrate the specific claimed effect. Generic claims about "vitamin D and health" without a defined, measurable physiological effect are rejected. The claim must specify the effect — bone mineral density, calcium absorption, muscle function — and the study must measure that effect.
Protocol deviations between the pre-submission notification and the executed study. Under the Transparency Regulation, any deviation must be documented and justified. Unjustified deviations — particularly those that align with interim results — trigger scrutiny.
Inadequate statistical power or study duration. Underpowered studies produce inconclusive results, which EFSA interprets as failure to substantiate, not as insufficient evidence to reject. The burden of proof rests with the applicant.
Cost-Benefit Position
Submitting a vitamin D health claim application to EFSA is a high-stakes process. The 70%+ rejection rate means the expected value of a marginal application is low. The cost of generating compliant human intervention data, compiling a dossier that meets EFSA's 2017 guidance, navigating pre-submission notification under the 2019/1381 Transparency Regulation, and sustaining an 18-month evaluation timeline is substantial.
The rational strategy for most food business operators is not novel claim submission. It is reliance on the existing authorized claims in the EU Register, combined with formulation work that meets the "source of vitamin D" compositional threshold at the end of shelf life. Novel claim submission is justified only when the applicant has access to proprietary human intervention data, a defined product differentiation that cannot be captured by existing claims, and the financial capacity to absorb the regulatory timeline.
For researchers and policymakers analyzing the intersection of vitamin D biochemistry and fortification policy, the EFSA submission framework is the operational filter through which any food-based vitamin D intervention must pass to reach consumers with a health claim. The 15 µg Adequate Intake, the 10 µg AI for infants, the "source of vitamin D" threshold, and the 5-month evaluation clock are the operative parameters. Anything outside these parameters does not enter the authorized claims register.
